A AEAJ, a EAJ, a Medel e a Judges4Judges remeteram uma carta conjunta, dirigida ao Presidente Macron, dada a presidência francesa da União Europeia, motivada por uma proposta de lei polaca, efectuada com vista a poder receber fundos comunitário, proposta essa que visa ultrapassar as reformas levadas a cabo naquele país e que põem em sério risco a independência do poder judiciário. Esta proposta de lei, no entanto, não dá resposta às exigências feitas pela União Europeia, tendo sido esta circunstância a que motivou a remessa da mencionada carta.

Na sequência dos novos desenvolvimentos ocorridos na Polónia, levamos ao vosso conhecimento a declaração emitida pela Associação Europeia de Juízes (AEAJ), a que pertencemos , conjuntamente com a EAJ, Judges for Judges e MEDEL.

O Conselho Português para os Refugiados(CPR) procedeu à publicação do relatório anual AIDA sobre a situação do asilo em Portugal relativo a 2021.

Disponível em www.asylumineurope.org, o relatório inclui uma caracterização detalhada dos procedimentos de asilo, condições de acolhimento e detenção dos requerentes de protecção internacional, bem como do conteúdo da protecção internacional em Portugal. O relatório contém, igualmente, um sumário das principais vicissitudes do sistema de asilo nacional registadas desde a publicação da edição anterior.

Caros colegas, no âmbito da nossa missão de acompanhamento da situação na Ucrânia e de colaboração com as entidades responsáveis pelo incremento de projectos internacionais de salvaguarda dos direitos humanos, partilhamos convosco a carta que nos veio dirigida dos Presidentes do CCJE, CEPEJ e CCPE relativamente aos Juízes Ucranianos que estão neste momento a necessitar de ajuda.

Apelamos à vossa participação, a qual deverá seguir o procedimento descrito na carta que publicamos por forma a que fiquem assegurados os objectivos visados com a criação desta nova plataforma de apoio.

A FRA (European Fundamental Rights Agency) publicou o relatório EU-Ukrainian border check points: First field observations, disponível on line, que sintetiza as observações feitas pela FRA nas fronteiras húngara, polaca, romena e eslovaca com a Ucrânia e a Moldávia.

Este breve relatório destaca, em particular, como os países da UE lidaram com os desafios dos direitos fundamentais, relacionados com:

a) recepção;

b) o risco de tráfico de seres humanos;

c) controlos de passaportes nos postos de fronteira visitados;

d) próximos passos.

Com vista à divulgação de iniciativas de apoio ao povo ucraniano, partilhamos a mensagem que foi feita chegar por colegas da Polónia e a pedido dos mesmos:

We are witnessing a violent invasion of Russia against Ukraine. Despite this difficult time Ukrainian judges are still on duty, trying to continue their work. Polish judges are involved in the huge action of help which is now taking part in Poland and support the family members of the Ukrainian judges, who have arrived in Poland.

The needs are enormous and various. For those, who cross the border and decide to stay in Poland, the most important and urgent problem to be solved is to obtain a secure accommodation and – in the nearest future – also a new job.

If you are also willing to help, there is such an opportunity. All sort of support is welcome, especially accommodation in any EU country and, of course, donations, which may be done here:

A AMJAFP, em articulação com a AEAJ, tem vindo a promover e divulgar diversas iniciativas de apoio a todos os cidadãos ucranianos, de condenação da invasão e de total repúdio pela violação dos direitos humanos que a guerra tem gerado.

Recebemos hoje, da AEAJ, informação actualizada da situação ao nível dos tribunais e um apelo, directamente dirigido pelos nossos colegas ucranianos, no que respeita a donativos, que entendemos partilhar:

 

“Dear colleagues,

Some updates and information:

1) on short notice, our Rule of Law officer, Eva, could attend a Zoom meeting on Ukraine recently, in which the president of the Ukraine Supreme Court informed the participants briefly about the state of Ukraine judiciary for the time being:

He informed that that approximately 600 courts are still functioning.

Approximately 40 courts in the Eastern parts (occupied parts) do not function any more. Judges were obliged to apply Russian law, what they denied to do so. There is basically no contact now to these parts of Ukraine.

It is relevant to evacuate and secure court paper files now.

Ukraine judges of the Supreme Court donate approximately 50-60% of their remuneration to the Ukraine army or for humanitarian needs.

Quite many male judges are serving in the army now, many of the female judges do either volunteer in the Ukraine army or work for charity needs.

It was stressed that donations for the Ukraine army would be warmly requested. Donations do not only go directly to the army but also to charitable NGOs and their work.

4) let me also share with you the message from Murat Arslan - president of the Turkish Independent Judicial Association YARSAV – you remember that Murat is in detention since 2016 and has received the Vaclav-Havel price of the Council of Europe in 2017 for his defening human rights:

«Law and Peace for All

It breaks my heart to watch the human tragedy in Ukraine from the prison cell where I have been held for the last six years. My heart and mind are with Ukrainians and especially with my Ukrainian colleagues.

I regretfully observe that the occupation of Ukraine, which has made great strides towards becoming a rule of law, by a totalitarian regime threatens not only the peace and security of Ukraine, but the entire world. With the occupation of Ukraine by Russia, we have seen how important the struggle for the rule of law, democracy and human rights is not only for legal security, but also for the safety of each individual's life and international peace.

An important point that should not be ignored during this period; It is the fact that a significant number of individuals and organizations who have realized the value of human rights and freedoms among the Russian people are trying to bravely oppose the occupation.

It is clear that the most effective method of honoring both the people who believe in the rule of law and democracy among the Russian people and the victims in Ukraine is to embrace the rule of law in Europe more and more sincerely against the Russian occupation, which has trampled international law.

The most appropriate response to this invasion should be based on international law and human rights. Blaming all people for the sins of a totalitarian regime can cause incurable wounds and sow new seeds of hatred. The best answer is to further strengthen democracy and human rights. All the happenings should be viewed with a focus on human beings and the environment, so humanity should not be sacrificed for political interests.

As far as I can follow from the prison cell, I see that the victims of this occupation are immediately extended a hand, especially in Europe. I have no doubt that our Ukrainian colleagues are also helped.

I believe that goodness is contagious and there is always strength in unity.

I offer my respects to those who stand by them and show solidarity in these difficult times. I wish this occupation, this humanitarian tragedy, this huge destruction to environment and law to come to an end as soon as possible. I would like to emphasize again that the ability of each individual to live in peace depends on each individual's ability to live in law. The abandonment of law in one country is a threat to all peoples of the world».

Decidindo responder afirmativamente ao apelo que foi lançado pela AEAJ, a AMJAFP emite e partilha aqui uma declaração de condenação ao conflito armado na Ucrânia.
As cores da nossa página e das nossas redes sociais estarão também temporariamente alteradas, em homenagem ao povo ucraniano.

 

A Associação dos Magistrados da Jurisdição Administrativa e Fiscal de Portugal (AMJAFP) expressa a sua profunda condenação ao conflito armado em curso na Ucrânia e, muito particularmente, à injustificada e crescente violação dos direitos fundamentais dos Cidadãos Civis Ucranianos.

Neste contexto, apelamos a todos os intervenientes políticos para que redobrem os seus esforços na criação urgente das condições necessárias ao imediato restabelecimento da PAZ na Ucrânia e para que sejam respeitados os princípios do Estado de Direito Democrático e os direitos fundamentais de todos os cidadãos ucranianos, tal como consagrados na Declaração Universal dos Direitos Humanos.

 

The Association of Magistrates of the Administrative and Tax Jurisdiction of Portugal (AMJAFP) expresses its deep condemnation to the ongoing armed conflict in Ukraine and, in particular, to the unjustified and increasing violation of fundamental rights of Ukrainian Civilian Citizens.

In this context, we call on all political actors and civil society to adopt all measures that can contribute to create the necessary conditions for the immediate restoration of PEACE in Ukraine and for respecting the principles of the democratic governed by the rule of law and the fundamental rights of all Ukrainian Citizens, as enshrined in the Universal Declaration of Human Rights.

- Veja aqui a carta dos presidentes dos tribunais constitucionais da Estónia, Letónia e Lituânia, dirigida à Comissão de Veneza e a todos os membros da CECC (Conference of European Constitutional Courts) com a proposta de retirar a adesão do Tribunal Constitucional da Federação Russa, bem como da Bielorrússia (associate member) do CECC.

 

Além disso, propõe-se a retirada do presidente do Tribunal Constitucional da Federação Russa enquanto um dos oradores principais do próximo Congresso da Conferência Mundial sobre Justiça Constitucional.
